Terms of Service & Liability Waiver
LIABILITY WAIVER, & TERMS AND SERVICE AGREEMENT
By requesting or accepting roadside assistance services from MCKEEINS, LLC dba Tier-1 Roadside Rescue, the customer agrees to the following terms:
1. Voluntary Request for Service
Customer voluntarily requests roadside assistance services including, but not limited to, tire changes, jump starts, fuel delivery, vehicle unlocks, and minor roadside services.
2. Limitation of Liability
Company, Owners, Contractors and company employees shall not be liable for any damage to Customer’s vehicle, property, personal injury, injury, death, or loss that may occur before, during, or after services are performed. Customer understands that roadside assistance involves inherent risks and agrees to assume all risks associated with the services. Customer further agrees that MCKEEINS, LLC dba Tier-1 Roadside Rescue shall not be responsible for any accidents, injuries, death, or damages that occur after services are completed, including but not limited to incidents caused by driver negligence, speeding, reckless driving, erratic driving, mechanical failure, or unsafe operation of the vehicle.
3. Not Responsible for Pre-Existing Damage
Company is not responsible for any pre-existing damage to the vehicle including, but not limited to:
- Scratches
- Dents
- Mechanical issues
- Tire or wheel damage
- Alignment or suspension damage
- Interior damage during lockout service
4. No Guarantee of Service Outcome
Company does not guarantee that any roadside service will successfully start, unlock, repair, or move the vehicle. Customer agrees that payment is for labor and service attempt, not a guaranteed result.
5. Release of Liability
Customer releases, waives, and discharges MCKEEINS, LLC dba Tier-1 Roadside Rescue, its owners, employees, contractors, and affiliates from any and all liability, claims, demands, damages, or causes of action arising out of or related to the roadside assistance services provided.
6. Indemnification
Customer agrees to indemnify and hold harmless MCKEEINS, LLC dba Tier-1 Roadside Rescue from any claims, damages, or expenses resulting from the services performed.
7. Payment for Services Rendered
Customer agrees to pay for all services rendered regardless of outcome once service work has begun.

This agreement shall be governed by and interpreted under the laws of the State of Texas.
